1. INTRODUCTION
These Terms and Conditions constitute a legally binding agreement made between you, whether personally and dumart.xyz , 177 (2nd floor), BUET Market, Palashi (we, us), concerning your access to and use of the Dumart (https://dumart.xyz/) website as well as any related applications (the Site).
The Site provides the following services. You agree that by accessing the Site and/or Services, you have read, understood, and agree to be bound by all of these Terms and Conditions.
If you do not agree with all of these Terms and Conditions, then you are prohibited from using the Site and Services and you must discontinue immediately. We recommend that you print a copy of these Terms and Conditions for future reference.
The Site reserves the right to change, modify, add, or remove portions of these Terms and Conditions at any time without any prior notification. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions regularly for updates. Your continued use of the Site following the posting of changes to Terms and Conditions of use constitutes your acceptance of those changes.
SECTION 1 CONDITIONS OF USE
A. YOUR ACCOUNT
To access certain services offered by the platform, we may require that you create an account with us or provide personal information to complete the creation of an account. We may at any time in our sole and absolute discretion, invalidate the username and/or password without giving any reason or prior notice and shall not be liable or responsible for any losses suffered by, caused by, arising out of, in connection with or by reason of such request or invalidation.
You are responsible for maintaining the confidentiality of your user identification, password, account details and related private information. You agree to accept this responsibility and ensure your account and its related details are maintained securely at all times and all necessary steps are taken to prevent misuse of your account. C .COMMUNICATING WITH US
When you visit the Site, or send email to us, you are communicating with us electronically. You will be required to provide a valid phone number while placing an order with us. We may communicate with you by email, SMS, phone call or by posting notices on the Site or Official Social Pages (Facebook, LinkedIn, Instagram, etc.) or by any other mode of communication we choose to employ. For contractual purposes, you consent to receive communications from us with respect to your use of the website and agree to treat all modes of communication with the same importance. D. FRAUD ALERT
We will take legal action if we receive evidence of fraud and illegal and any type of money transaction between customer and seller. This is strictly prohibited. And, if any customer is found placing orders without any intention to take delivery (usually via COD), the customer may get a permanent ban from Dumart.xyz and in extreme cases may legal steps be taken from the company. The same instruction is applicable for the people who buy and alter the delivered items with another faulty/different item in absence of any witness and after sometime claims refund or return with invalid claims.
E. TERMINATION
In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions or revoke any or all of your rights granted under the Terms and Conditions. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall, in addition to any other legal or equitable remedies, immediately revoke all passwords and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with the Site or with any terms, conditions, rules, policies, guidelines, or practices in operating the Site, your sole and exclusive remedy is to discontinue using the Site.
F. OTHERS
Stock availability:
Dumart reserves the right to refuse to honor an order. This means that if an item unexpectedly goes out of stock after an order is placed or the company decides to stop selling an item, the company has recourse:
All products are subject to availability and we reserve the right to impose quantity limits on any order, to reject all or part of an order, and to discontinue products without notice, even if you have already placed your order. Your placement of an order as a customer does not necessarily assure that we will accept your order. We reserve the right to refuse any order at our sole discretion. In addition, before accepting your order, we may require additional information if you have not provided all the information required by us to complete your order.
Delivery Timeline:
The delivery might take longer than the usual timeframe/line to be followed by Dumart. As per the government law and policy, Dumart will deliver any item that is in physical stock within 10 working days. But, Dumart will do it’s best to hand over your items at its earliest.
Delivery might be delayed due to force majeure event which includes, but not limited to, political unrest, political event, national/public holidays, Covid lockdowns or movement limitations, etc
Cancellation:
Dumart retains the right to cancel any order at its sole discretion prior to dispatch and for any reason which may include, but not limited to, the product being mispriced, out of stock, expired, defective, malfunctioned, and containing incorrect information or description arising out of technical or typographical error or for any other reason.
Refund Timeline:
If any order is canceled, the payment against such order shall be refunded within 72 hours to 10 working days, but it may take longer time in exceptional cases that are related with other payment gateways, government authorities or any. Provided that received cash back, bonus, apology amount, gift amount, if any, will be adjusted with the refund amount when applied.
SECTION 2 – PRICING AND PAYMENT METHODS
All prices are subject to change without notification, and while every effort is made to ensure the accuracy of the prices displayed on Dumart, they are not guaranteed to be accurate. If any price is different from that displayed we will inform you before dispatching the order and you will have the option of continuing with the order or not.
We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the Site. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your pre-payment processed. If such a cancellation occurs on your prepaid order, our policies for refund will apply.
SECTION 3 – CHANGES TO TERMS OF SERVICE
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Following the updates in eCommerce policies and laws in any respective time, we may change and update our terms and conditions anytime without prior notice.
